Terms of Service

1. Who these terms are with
These terms govern your use of www.scalevisibility.com and app.scalevisibility.com, operated by Joshua Winningham, a sole proprietorship based in Arizona, USA, doing business as Scale Visibility ("we", "us").
By using the site or the product, you agree to these terms. If you're agreeing on behalf of a company, you confirm you're authorized to bind it.
2. What the product is
Free tools and the free score. Our tools and the instant AI search readiness score are provided free, with no account required. They give you a score, issue counts, and an estimate of what your page speed may be costing you.
The full audit ($49, one-time). A paid audit unlocks, for one website: every issue found with a paste-ready fix, PageSpeed and Core Web Vitals data, an AI citation check across ChatGPT, Claude, Gemini, and Perplexity, and the same technical audit run against up to three competitors. The purchase is one-time, per site, and is not a subscription. It includes up to three citation check runs.
Done-for-you work. Implementation services (the "Tune-Up") are quoted separately and are governed by their own agreement, not by these terms.
3. What the product is not — please read this one
We do not guarantee that AI assistants will name your business, or that your rankings will improve. We diagnose technical readiness and report what AI assistants said at a specific moment. We do not control ChatGPT, Claude, Gemini, Perplexity, or Google, and we cannot make them cite you.
AI results are a point-in-time snapshot and are not reproducible. Large language models are non-deterministic: the same question can produce different answers on different days, and providers change their models and their web-search behavior without notice. A citation result tells you what happened when we asked. It is evidence, not a measurement of a fixed quantity, and re-running it may produce a different answer.
Revenue estimates are models, not predictions. Where we estimate revenue impact from your page speed, we say so, and we cite the assumptions. Those figures are illustrative and depend on inputs we cannot verify (your traffic, your conversion rate, your average order value). Do not treat them as financial projections.
Technical findings are automated. Our audit is a program that crawls and checks your site. It can miss things, and it can flag things that don't matter for your particular business. Apply judgment before making changes, and back up your site before pasting in generated code.
4. Your account
You're responsible for keeping your password secure and for what happens under your account. Tell us promptly at hello@scalevisibility.com if you think it's been compromised. One person or business per account; don't share logins.
5. Acceptable use
Don't:
- Audit websites you don't own or aren't authorized to analyze
- Try to bypass rate limits, run automated scripts against the service, or resell access
- Attempt to break, overload, reverse-engineer, or gain unauthorized access to the platform
- Use the service to build a competing product
We rate-limit free runs (5 per IP per day for the score; 3 per day for the AI Visibility Check) and may suspend accounts that abuse the service.
6. Payment and refunds
The audit is $49 USD, one-time, per website, charged through Stripe at the founding price in effect when you buy. Prices may change for future purchases; what you paid is what you paid.
Refunds: if you're not happy with your audit, email hello@scalevisibility.com within 7 days of purchase and we'll refund you in full, no questions asked. Refunds go back to your original payment method, typically within 5–10 business days.
If a refund is issued, access to the paid report, the citation checks, and the competitor comparison for that site is revoked.
7. Who owns what
You own your data. Your website, your business information, your audit results, and anything you enter remain yours. You grant us only the licence needed to run the service: to crawl your site, to include your business details in queries to AI providers, and to store and display your results back to you.
We own the platform. The software, the audit engine, the scoring methodology, the report formats, and the Scale Visibility name and branding are ours. Buying an audit doesn't transfer any of it.
Generated fixes are yours to use. The robots.txt, llms.txt, and JSON-LD schema we generate for your site are yours, with no restrictions and no attribution required.
Anonymous free score reports are public by design. They live at a shareable link, and anyone with the link can read them. Don't run one on anything you consider confidential.
8. Availability
We aim to keep the service up, but we don't promise any specific uptime. We may change, suspend, or discontinue features. If we discontinue a paid feature you've bought and haven't been able to use, we'll refund you fairly.
Third-party dependencies (AI providers, Google's PageSpeed API, Stripe) can fail or rate-limit us, and some parts of the product won't work when they do.
9. Termination
You can stop using the service or ask us to delete your account at any time. We may suspend or terminate an account that breaches these terms, and we'll tell you why unless doing so would be unlawful or unsafe.
10. Disclaimers and limits
The service is provided "as is", without warranties of any kind, express or implied, to the fullest extent the law allows.
Our total liability to you for any claim is limited to the amount you paid us in the twelve months before the claim — for most customers, $49. We are not liable for indirect, incidental, or consequential damages, including lost profits or lost business, even if we were told they were possible.
Nothing here limits liability that cannot be limited by law.
11. Indemnification
If you use the service to audit a website you don't own or weren't authorized to analyze, and someone brings a claim against us because of it, you agree to indemnify us — that is, to cover the resulting costs, damages, and reasonable legal fees. The same applies to claims arising from your breach of these terms or misuse of the service.
12. Governing law
These terms are governed by the laws of the State of Arizona. Disputes will first go to mediation; if that fails, to binding arbitration in Maricopa County, Arizona. The prevailing party may recover reasonable attorney's fees and costs.
13. General
If any part of these terms turns out to be unenforceable, the rest still stands. These terms are the entire agreement between us about the service and replace any earlier discussions. If we don't enforce a term right away, we haven't waived it.
14. Changes
We may update these terms. Material changes will be announced by updating the date above and, for account holders, by email. Continuing to use the service after a change means you accept it.
